First of all, what is an Expungement? Well, contrary to popular belief, when a criminal charge is dismissed, the charge itself still remains on your record—forever in Virginia. If a charge was dismissed (with no delayed adjudication), nolle-prossed, or if you were found not guilty, you can petition the Court to remove the charges from your record – this is called an Expungement.
